Lobbyists try to influence Congress. How can anyone get a fair trial when the press lies and poisons the jury pool? How about the media etc poisoning the judges? There are legitimate reasons to be concerned about the potential for any type of prejudicial indoctrination but the media including especially the local newspapers do it as a matter of course when they inject their opinions in news reports. It’s called FAKE NEWS. Witness tampering may be a crime but it’s an attempt to rig the jury.
The Sixth Amendment contains a guarantee to every criminal defendant, a trial by an impartial jury of his peers. This right has been declared a “fundamental right ” — one that is implicit within the concept of liberty and justice — and thus, made applicable to the states through the due process clause of the Fourteenth Amendment.
HERD MENTALITY:
There is mounting psychological evidence: Collective judgments differ dramatically from individual judgments, and the “wisdom of the crowd” also has a dark side in the form of a herd mentality. Our system of jury trials – with strict rules of evidence and reliance only on information presented in the courtroom – is designed precisely to combat mob rule. As the recent trial of Casey Anthony, as well as the upcoming trial of Dr. Conrad Murray illustrate, maintaining that distance from the crowd’s beliefs can be difficult.
MOB VIOLENCE
Comes from the tendency of most people to accept the view of the mob they are in at the moment. It may be religion based, race based or media based but the lowing herd can and has killed.
POSSE COMITATUS
Commits the followers to the leader, not to the public or to the individual. It is against the individual.
The poisoned Jury Pool operates as a 5th column behind the scenes to upset a fair trial free of bias.
