The answer is of course they don’t get it anywhere in a free country. The While there are numerous examples of government shutting down legal, legitimate commerce the question is: where did they get that power and the answer is they don’t have it. What they do have is police and the ability to direct them against individuals. It’s illegal. It’s illicit. But they have the means, the command and control of the police and their willing help against the people. The Ninth Amendment makes it plain the power is with the people, not the police, the military or the government. The tenth Amendment makes it clear that the Federal Government doesn’t have that power and that if proper it is a power of the state but if not, the power rests with the people. All force is under the control of the the people who sort of give it to the government but the people have placed it there because they needed to. Since it was by the people or in the name of the people it’s clear the people can remove the police power as they will.
