Because Race Includes Attributes.. Because Depraved Indifference Matters…. Because testing for Depraved Indifference is perhaps too difficult for measure with accuracy…Because we must do better when it comes to measuring attributes. We must consider race because race matters. Black people and white people are insufficient to characterize every person because there are exclusive traits for every black and every white person because race and individuality matter. The five Memphis policemen were men. They were measured and tested and catorigized insufficiently and the unfortunate result is Tyre is dead because of massive race based failures among other failures.

Failures in testing. Failures in the human ability to conceive, create and execute testing and the human ability to “beat” psychocological testing. We must do better. The present attitudes were insufficient. The present attitudes are wrong. Tyre Nichols represents many failures. Unfortunately it does not represent any race based successes. Race Matters!! Take race into account? Everyone does. Take race into account in the judgment of the Memphis Five? Yes.. Everyone is doing it. Liberals who want to excuse bad behavior. Conservatives who want to accept everyone as equal. Prince Harry? Oprah? Dr. Ben Carson? The Memphis Five? This is not over. Race is not over. When will it be over? Probably never.
