because it was seen by millions making it far worse than if it was done in some dark alley. Smith is laughing at his crime, .. it was assault and battery, .. and the Academy must penalize Smith in part because it cannot be seen as supporting his actions and in part because his actions were criminal. He had plenty of time to reflect what he intended to do so there was pre-meditation. That increases the wrongness of his violence. It also adds to the preception that black men cannot control their impulses and that black men are violent so the entire black community needs to get behind the issue of a penalty for Will Smith. There’s no excuse for inaction or for fence straddling. We witnessed assault and battery.
