Fani did not prove that those who made such statements did it knowing they were false. Making a statement is protected speech regardless of whether it’s true or false. Congress cannot make a law that controls that and Fani certainly cannot be correct when she claims she knew what someone was thinking when they made such statements. Besides. If the speaker decided to say they retract their statement, then they cannot be held to have made it is the first place since the retraction makes it disappear. A statement that has disappeared is not in existence so no one can be held reponsible for making it.
