As president or ec-president he was not forbidden to use calssified material, he was forbidden to Not Misuse it. He knowingly mis-used it. Unfortunately for prosecutors Biden was not in his right mind, was senile, under the influence of dementia, confused, stumbling intellectually and unfit and therefore unable to be prosecuted. Also, unfortunately the tapes on which the evidence can be heard may have been forged. Maybe not… Probably not but the allegation can be made and the proof they were not forged requires the proving of a negative which is impossible.
