“Carolyn Lerner, head of the U.S. Office of Special Counsel concluded that Secretary of the Department of Health and Human Services Kathleen Sebelius violated the Hatch Act when she served as the Guest of Honor and Keynote Speaker at the February 25, 2012 gala for the pro-gay rights Human Rights Campaign in Charlotte, North Carolina.”

Sebelius made political remarks when spoke in her official capacity. That’s the violation. She attempted to re-fashion her violation as spending government money so she had The Democratic Committee reimburse the government but that’s like committing rape on a business trip and repaying the cost of the motel. Sebelius cannot continue to be the Secretary of HHS. As an ethical person, Sebelius would resign. In an ethical adminstration, which definately does not describe the Obama adminstration, she would be fired. Paying the cost of the trip does not cure the violation.
