LOOK UP! Drive along Holland Road. Count the sagging cables, connectors, boxes, transformers,  splice connectors & cross-arms. It took 26 years of Komo & his political insider GOP cronies [who also ruined the Northampton GOP Committee] to get this much arial ugly. Neighboring Philadelphia has less ugliness on the towers. The birds in Northampton are constantly taking detours because the flyways are so junk-cluttered. Hummingbirds need to watch out for the nearly solid wall of ugly on the poles.

So after helping ruin Northampton by never passing a proper Right-of-Way Ordinance, which lack allowed American Tower Company to add 60 more poles and cables, Northampton’s two Cheap Shot Supervisors, Silver and Komelasky, try to deceive the people by refusing to follow the agenda or respect the citizens right to talk at the special cell tower meeting May 15. Review the video. Watch as Komo-Sil act out their political-stunt-empty-motion which forced people who follow the rules, (unlikeKomo-Sil) to restrict  comments to define Komo-Sils motion.

Then notice how the people and the new township solicitor skillfully turned the Empty Motion into something that would work.

Last November the people had to vote out one of the dirtiest adminstrations in Bucks County. Republican voters had to join with Democrats to clean up Northampton. So far it’s working. Secret deals made out of our sight over the past half-century by Komo & Co, are becoming known. More on those later but for now the Democrats on the Board of Supervisors must try to clean up Komelasky’s mess on the Cell Tower Faliures. But Komo-Sil don’t undersand what the people did at the May 15 meeting. The people stepped up and helped fix Komo’s mess. Makes this old scribe proud, but not of Komo-Sil who embarassed the adults in the audience as Sil gave a kindergarten gesture when the motion the people had to fix was passed by the Board.

Now the township needs to file an Injunction to stop further construction until some planning can take place. ATC is not a utility but a construction company and a tower rental company. The courts must have been mislead to give them the power to put up their ugly poles in our neighborhoods. If so, that’s Fraud and fraud invalidates a contract.

ATC needs to be stopped until some better plans are made.

Over the past 25 years, the townshp has utterly failed to control the appearance of the utility poles so the township looks ugly with all the cables, boxes, crosspieces, bolted-on provisional looking junk hnging over our roads. Richboro is a disaster except for the township buildings where they prohibited poles and wires.  A nice view is OK for the goverment but not for the people.

The township needs to take ATC, PECO and the cable companies to court and get a judges ORDER to stop trhe ATC tower construction and to clean up the cable mess in Northampton.

“But thus I counsel you my friends: Mistrust all in whom the urge to punish is powerful. They are people of a low sort and stock; the hangman and the bloodhound look out of their faces.”

Reminds me of the now visible Urge to Punish citizens by the two remaining Republican’s on the Board of Supervisors who  are part of a thankfully few remaining unsuccessful leaders of the Northampton Republican Committee which consists of  36 sycophants who, long ago wilted against the corrupt winds blowing thru their ranks.

The residents need to hear the construction has been postponed at least for a few weeks until some better alternatives are thought up.

The towers are ugly. The people who constantly keep up the appearance of thei properties need to hear ugliness in forbidden. They need to hear that unless the signal strength maps show there is no possible alternative to the DAS,  that the construction is stopped. They don’t need to be told that the 43 foot high poles on their front lawns are safe. Their properties have registered deed restrictions against towers. Government needs to protect the property of the citizens, not let some, one percenter have priority over the rights of the citizens. The residents need to hear  the approvals by the township were a series of mistakes and the township is going to stop it.

The mistake that is material is not only that the residents were not informed, they were sold out. Their properties were sacrificed, not protected.

The mistakes, and there were many, included that the 59 new towers and scores of “toppers” that extend the height of existing poles, were approved without consideration of the properties involved, and without considering the duty of the township to protect the physical property. A big mistake was not being aware of the deed restrictions. Another series of mistakes was there were no alternatives presented. Another that the township engineers, the Zoning manager, the Telecommunications board members and all of the township attorneys and mamagers  failed to think up alternative ways to get the proper signal levels.

A very big mistake was keeping it all secret. If the best interests of the residents were protected in the secret meeting and the trial then there would be only the problem of the violations of the Sunshine act but the secrecy covered up the failure of Northampton to protect the citizens. 

I bet there are no signal maps in the possession of the township. How can anyone know that the towers are the best alternative when there is no information about why they are necessary?

 I would be shocked to know anyone on the Telecommunication Board or in the Zoning department which was supposed to look after the residents and to protect their properties, knows much about antenna systems. I have not heard anyone in government talk about the cables connecting the towers and the trenches being dug. I have not heard anyone in government tell the besieged citizens that ATC cannot block the on-street parking in front of the properties and just take over the streets and lawns of the residents. I have not heard anyone say that the residents can park whatever they want in front of their properties and maybe on their lawns and if ATC wants them to remove their cars they can produce a judges ORDER. What’s going on in America when some construction company that is not a utility, not approved as a utility by the PUC not approved by the FTC can come onto private residential property and rip it up? Of course we know how government folds up in the face of big money bribes.

Why is no one except me thinking up these tactics to get things at least slowed down until some of the required information is developed.?

I know some of the supervisors want to help but I hope no one in government plans to hold a meeting to show how safe these towers are or how they are not so bad looking. The people don’t need that. They need this stopped and it’s going to be cheaper for ATC if it’s stopped before more towers are constructed in front of the residents homes.

But keep in mind the secrecy that went on for many months within the Board of Supervisors. Most likely some of the secret discussions violated the PA Sunshine act. Even worse for the Supervisors they got caught, — this time. Perhaps their plans to keep people, probably even some supervisors in the dark would have suceeded except for the fighting spirit of some great American neighbors. Americans push back.

Why is unconstitutional power important? Because an Emergency Injunction in Federal Court, (6th and Arch) can be granted if the lawsuit involves a Constitutional question. Private Property Rights provide one Constitutional basis for filing for Emergency Protection of Property. Four elements need to be proven to obtain an Injunction. A Constitutional attorney should know them. I’m not an attorney but I did file a Pro-Se Emergency Petition for Injunctive Relief in Federal Court and the judge scheduled the hearing within 48 hours. Two years later the judge ordered Northampton and three other townships to remove the unconstitutional ordinances against which I sought relief even though the judge did not grant the original injunctions. Years later Northampton put the ordinance back into their two inch thick book of ordinances and again I had a federal judge order it removed. Some people (Northampton Supervisor Komelasky was in power during both Northampton lawsuits) never learn.

The authors of the Constitution did not exactly understand the difference between Rights and Power. That knowledge is still imperfectly known because Rights is a relatively new issue in human history. Basically governments have Power, individuals have Rights, and Rights are supposed to be able to limit Power. The fact that Power has grown and Rights have been diluted until today people unwittingly ascribe Rights to government as well as to plants, animals and the environment proves how imperfectly Rights are understood.

It takes a lot of information to win a constitutional lawsuit against a township. I won five. I hope some attorney will help file for Emergency Injunctive Relief about the Northampton Cell Towers because I’ve known government is too powerful for decades and it’s about time that knowledge gets thru to some of these petty tyrants. Rights trump Power but it takes a special kind of attorney to get the job done. The trouble with the NRC is their stunning naivete and their silence. The worst kinds of leaders, several men driven by hate have taken the NRC into new depths of hatred.
